    Dog waste fine at apartment ???

    Hi,
    I don't know if anyone here has experienced this situation, but I really need some advices.
    I received a fine letter from my apartment's managment office, $200, for dog waste. I understand that they have a policy where you need to pickup your pet's waste and I do pick them up everytime. However, sometimes my boyfriend walks the dog when I'm not home and I'm unsure if he does his duties.  My question is, should I just go ahead and pay or I can fight back if they don't have any proof? I'm pretty upset at the moment because I already pay 250 for monthly maintenance fee ( I own my apartment unit) and I get fined for this ridiculous reason.
    200 is one expensive poop pile.

    Well if someone saw your dog take a squat with your boyfriend and he didn't clean it up then I think it's reasonable.  It's your dog and your responsibility.  Ask what their justification was for the fine though.  If they say someone saw you and you know you never slip up then why not try to fight it?  $200 is alot of money.

    Sorry but in the eyes of the law, he was acting as your agent.  Therefore, you are responsible.

    Well, for starters I guess you need an honest answer from bf about whether he picks up.  If he does, then I'd certainly ask how it was determined that the waste was identified as belonging to your dog.

    Check and make sure no one else in your complex owns a dog. I have been yelled at by my manager for not picking up dog poop, even though every time I do. I then found out 3 other people in my complex have dogs, that my manager didnt know about!

    I always worried about something very similar happening to me - everyone in my building seemed to own a dog, and no one picked up after them - especially the guys on the first floor. I always worried that they might think the huge amounts of fecal matter left out there belonged to my dog, considering he was the biggest one in my building. But I reasoned that there was no way they could ever do anything to me because my dog was afraid to do his business at the apartment - we went to a park about 5 miles away several times a day so he could do his duty and go for a walk.

    I'm glad I moved out of there because recently all the residents got fined for the poop - not just one person in particular. If I were you I'd find out how good your neighbors are at cleaning up to and then ask the question why they weren't fined too (if they weren't).

    I've lived in an apartment that had a $50 fine for poop and I saw them enforce it.  I was always hounding DH about picking up.  He liked to leave them for me to pick up [&:].  I didn't want him to be seen leaving the scene of the crime!
     
    I agree that you should ask why you are receiving the fine and if it's him, HE pays!

    thanks all for your replies.
    I've asked my bf and he stated that he did pickup poops "most of the time". He said he might slipped once or twice at night, but he normally did.
    I live in an apartment where EVERYONE has dogs and I've seen a lot of people walking their dogs without a plastic bag or anything to pickup waste. There are poops everywhere on the grass. I'm not happy with it but I've never told on anyone. My dog is about 30 lbs and I'v seen people with Great Dane dogs walking around without any waste pickup materials.
    I'm going to fight this, urgh.[:@]

    Sorry, but IMO I think you should take your medicine.

    1. It's your dog.
    2. Your boyfriend says he picks up some of the time so it could well be that someone saw him leave poop. Frankly, I'm tired of people who don't pick up their dog's crap some of the time. Their 'every now and again' and somebody else's 'every now and again' add up to alot of dog $hit.
    3. If you fight and you're in the wrong it will only make you look bad where you live.

    Just because they have no bags in sight doesn't mean they don't have any at all. My dogs never poop on our walks, but I do always have a poop bag in my jeans pocket just in case.
    If it was me, I'd pay the fine and just make sure it doesn't happen ever again.

    I would still inquire about it before paying.  That's a lot of money.  Did you know before hand that the cost of not picking up was $200? 
     
    JMO, but if a plce is going to charge they need to charge everyone every time.  I know our old place was picky and choosy about who they would go after for things, but other people were okay.  I don't agree with a policy that they make up as they go. Anyway.  If it's something where they are going to start charging everything, well, then, you may have to pay.  But at least your property will be kept clean.

    I would guess it's a lot like a speeding ticket, sometimes you get caught other times you don't.  I don't think most apartment complexes have employees who can watch every dog walker and see who leaves the poop each time.  So if your BF admits sometimes he doesn't pick it up, have him pay the fine.  30 lb dog or 120 lb dog, a rule is a rule and a poop is a poop.
